What Are Your Rights?

Adoption Leave entitles the individual adopting to take up to fifty two weeks off work. The first twenty six is Adoption Leave and this can be followed by an additional twenty six weeks Additional Adoption Leave. Adoption Leave starts up to fourteen days before the expected date of placement. Statutory Adoption Pay, where eligible is £102.80 per week or ninety per cent of weekly earnings if they amount to less than £102.80 per week. Additional Adoption Leave is usually unpaid.

Paternity Leave allows eligible employees to take one to two weeks off work after the child has been placed in your family. This leave must be taken within fifty six days of the child being placed. Investigate whether you would qualify for Statutory Paternity Pay (£102.80 per week,)

How Do I Qualify?

To qualify for Adoption Leave and Paternity Leave you must have worked for your employer continuously for at least twenty six weeks when you notify them that you have been matched with a child for adoption. 

When Do I Let My Employer Know?

They will need documentation, usually a matching certificate, to show that a child is to be placed with you by an Adoption Agency. This should be provided seven days before you wish Adoption Leave to commence.

To qualify for pay, you must be earning at least £79.00 per week.

These rights are In addition to the existing rights in place. These state that all employees both mother and fathers are entitled  to up to thirteen weeks unpaid parental leave to care for their child once they have completed one years service. This parental leave can be taken up to five years from the date of birth of the child or in the case of adoption five years from the date of placement.
