Adoption Leave (Overseas Child)
What Is Adoption Leave?
Individuals who adopt an overseas child, or one member of a couple who adopt jointly, may be entitled to adoption leave.
This is usually a period of twenty six weeks ordinary adoption leave, followed immediately by up to 26 weeks’ additional adoption leave. The other member of a couple or the partner of individuals who adopt may be entitled to paternity leave and pay.
How Do I Qualify For Adoption Leave?
- have worked for your employer continuously for at least twenty six weeks and give your employer the correct notification.
When Will Adoption Leave Start?
- you may choose to start your leave and pay either from the date the child enters the country or from a fixed date up to 28 days later
- your employer needs to know that you will be taking adoption leave within 7 days of receiving official notification, or completing your twenty six weeks service if later
- let your employer know the date that you recived official notification and the date that the child is expected to enter the country
- give your emplyer twenty eight days notice of the actual date that you want your adoption leave and SAP to start
Am I Entitled To Any Financial Benefits Whilst On Paternity Leave?
- to qualify for Statutory Adoption Pay (SAP) you must have earnings above £79.00
- SAP is £102.80 a week or ninety per cent of weekly earnings if this amount is less than £102.80.
- Additional adoption leave is usually unpaid
How Do I Tell My Employer That I Would Like To Take Adoption Leave?
- Provide them with a copy of the official notification twenty eight days before you wish to claim
- Provide further evidence of the date of the child’s entry into Great Britain,
